HBA-MPM H.B. 3646 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3646 By: Krusee Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, the State Board of Education (board) is authorized to grant additional charters for open enrollment charter schools for which 75 percent of the prospective student population will be students who have dropped out of school or are at risk of dropping out of school. H.B. 3646 authorizes the board to grant additional charters for open-enrollment charter schools for which a majority of the student population will be students who are economically disadvantaged. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 12.1011, Education Code, by amending Subsection (a) and adding Subsection (c), as follows: (a) Authorizes the State Board of Education to grant additional charters for open-enrollment charter schools for which a majority, rather than at least 75 percent, of the student population, rather than the prospective student population, will be students who are economically disadvantaged, rather than those who have dropped out of school or are at risk of dropping out as defined by Section 29.081 (Compensatory and Accelerated Instruction), Education Code. Makes a nonsubstantive change. SECTION 2.Emergency clause. Effective date: upon passage.
