DIGEST 

Currently, Texas law authorizes an owner of property containing a
third-class road or a specified neighborhood road, the right-of-way of
which was obtained without a cost to the county, to erect a gate that meets
certain requirements across the road.  This bill would authorize
neighborhood associations to erect gates on third-class and neighborhood
roads. 

PURPOSE

As proposed, H.B. 3684 authorizes neighborhood associations to erect gates
on third-class and neighborhood roads. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 251.010(a), Transportation Code, to authorize a
neighborhood association which owns or controls real property on which a
third-class road established under Section 251.053 is located for which the
right-of-way was obtained without cost to the county to erect a gate across
the road when necessary.  Requires the gate to be constructed as to not
cause any unnecessary delay to persons, including emergency personnel,
using the road, rather than a person. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Emergency clause.
