DIGEST 

The 74th Legislature exempted certain water wells from regulation by water
districts created after September 1, 1991.  The exemption hinders the Jeff
Davis County Underground Water Conservation District, created in 1993, in
the effective management of its water resources.  H.B. 3763 would provide
that certain limitation regarding water wells does not apply to the Jeff
Davis County Underground Water conservation district. 

PURPOSE

As proposed, H.B. 3763 provides that certain limitation regard water wells
does not apply to the Jeff Davis County Underground Water Conservation
District. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 5, Chapter 641, Acts of the 73rd Legislature,
Regular Session 1993, by adding Subsection (c), to provide that Section
36.121, Water Code, does not apply to the district. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3.Emergency clause.
