DIGEST 

Currently, there is no requirement regarding representation of the upper or
lower basins of the Sabine River Authority Board of Directors (board).
H.B. 3846 requires the board to be composed of four members from the upper
basin and four members from the lower basin. 

PURPOSE

As proposed, H.B. 3846 requires the Sabine River Authority Board of
Directors to be composed of four members from the upper basin and four
members from the lower basin. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS 

SECTION 1. Amends Section 3, Article 8280-133, V.T.C.S., to require four
members of the Sabine River Authority Board of Directors (board) to each
reside within a county located in the upper basin of the Sabine River,
including certain counties.  Requires four members of the board to each
reside within a county located in the lower basin of the Sabine River,
including certain counties.  Requires one member of the board to reside
within any county situated wholly or partially within the watershed of the
Sabine River.  Deletes text requiring nine members to reside in a county
wholly or partially within the watershed of the Sabine River.  

SECTION 2. Makes application of this Act prospective.

SECTION 3. Defines "upper basin of the Sabine River" and "lower basin of
the Sabine River." Requires the governor to appoint certain members to the
board when positions become vacant in a specified manner.  

SECTION 4. Emergency clause. 
           Effective date: upon passage.
