Currently, special restrictions are placed on the Jefferson County Drainage
District No. 7.  These restrictions were put in place prior to the
enactment of the Water Code.  H.B. 3847 would require this district to
comply with Chapter 49, Water Code, rather than the special legislation. 

PURPOSE

As proposed, H.B. 3847 requires the Jefferson County Drainage District No.
7 to comply with Chapter 49, Water Code, rather than the special
legislation. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Sections 3, 4, and 13, Chapter 34, Acts of the 57th
Legislature, 3rd Called Session, 1962, to authorize the Jefferson County
Drainage District No. 7 (district) to disburse moneys of the district on
checks, drafts, orders, or other instruments issued in accordance with
Chapter 49, Water Code.  Provides that the commissioners of the district
are elected in accordance with Chapter 49D, Water Code, and serve four
year-year terms.  Requires the moneys to be disbursed in accordance with
Chapter 49, Water Code; that Section 49.157, Water Code, applies to
deposits and investments, and that Chapter 49G, Water Code, applies to
audits of the district's fiscal accounts and records. Deletes language
authorizing the district to disburse moneys with the approval of certain
other public authorities.  Deletes composition of the commissioner of the
district.  Delete text that makes the County Treasurer of Jefferson County
the treasurer of the district.  Deletes requirements regarding money
disbursed by the district.   

SECTION 2.(a)  Effective date: September 1, 1999.
 
(b)-(e)  Sets forth requirements for the transition of elections up to the
third and subsequent elections of commissioners of the district. 

SECTION 3.Emergency clause.
