HBA-MPM H.J.R. 59 76(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 59 By: Dutton Public Education 4/21/1999 Introduced BACKGROUND AND PURPOSE Currently, school districts are liable for accidents to students who sustain injuries while riding as a passenger in a motor vehicle operated by or for the school district. As proposed, H.J.R. 59 requires the submission to the voters of a constitutional amendment authorizing the use of public funds or credit for the payment of premiums on personal injury protection insurance obtained through a motor vehicle liability insurance policy purchased by a school district to cover injuries sustained by a student while riding as a passenger in a motor vehicle operated by or for the school district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 52(a), Article III, Texas Constitution, by authorizing the use of public funds or credit for the payment of premiums on personal injury protection insurance obtained through a motor vehicle liability insurance policy purchased by a school district to cover injuries sustained by a student while riding as a passenger in a motor vehicle operated by or for the district. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 2, 1999. Sets forth the required language for the ballot.
