SRC-JJJ S.B. 23 76(R)BILL ANALYSIS Senate Research CenterS.B. 23 By: Nelson Criminal Justice 7/13/1999 Enrolled DIGEST Currently, Texas law provides that certain emergency protection orders issued by a magistrate remain in effect until the 31st day after the date of issuance. This bill will add an additional 30 days to the emergency protective order, to give a victim time to obtain a permanent protective order. PURPOSE As enrolled, S.B. 23 establishes provisions regarding the duration of certain emergency protection orders issued by magistrates. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 17.292(i), Code of Criminal Procedure, to provide that an order for emergency protection issued under this article remains in effect up to the 61st day, rather than the 31st day, but not less than 31 days after the date of issuance. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
