HBA-TYH C.S.S.B. 100 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.S.B. 100 By: Carona State Affairs 4/28/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Beginning in 1999, the U.S. Mint will issue five new designs on the reverse side of the quarter each year for the next 10 years to honor each state. Texas is eligible to introduce its commemorative quarter in 2004. C.S.S.B. 100 authorizes the governor to appoint an advisory committee (committee) regarding the design of a quarter dollar coin commemorating the State of Texas and makes other provisions regarding the committee members. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 401, Government Code, by adding Section 401.033, as follows: Sec. 401.033. DESIGN FOR QUARTER DOLLAR COIN COMMEMORATING TEXAS. Designates the governor as the state official authorized to consult with the United States secretary of the treasury regarding the design for a quarter dollar coin commemorating this state. Authorizes the governor to appoint an advisory committee to assist the governor, including formulating, soliciting, reviewing, or recommending a design or designs for the coin. Provides that if the governor establishes the advisory committee, the presiding officer of the Committee on State, Federal, and International Relations of the house of representatives serves as a member of the advisory committee by virtue of that position. Authorizes the governor to appoint other persons to the advisory committee as the governor considers appropriate. Provides that members of the committee are not entitled to reimbursement for expenses incurred in the performance of committee duties. Provides that this section expires January 1, 2005. SECTION 2. Emergency clause. Effective date: upon passage. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute modifies the original bill in SECTION 1(proposed Section 401.033, Government Code) by adding the provision that if the governor establishes the advisory committee, the presiding officer of the Committee on State, Federal, and International Relations of the house of representatives serves as a member of the advisory committee by virtue of that position. The substitute also authorizes the governor to appoint other persons to the advisory committee as the governor considers appropriate.
