C.S.S.B.107 would designate a tenth state holiday declaring March 31 as Cesar Chavez Day. Cesar Chavez was an outstanding national Hispanic labor and Chicano civil rights leader. This holiday can help all Texas citizens better understand and appreciate how farm workers' struggle led to greater freedom and opportunity for all. PURPOSE As proposed, C.S.S.B. 107 designates March 31 as Cesar Chavez Day. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 662A, Government Code, by adding Section 662.013, as follows: Sec. 662.013. OPTIONAL HOLIDAY FOR CESAR CHAVEZ DAY. Designates the 31st day of March as "Cesar Chavez Day" in observance of the birthday of Cesar Chavez. Authorizes the administrative head of a state agency to allow an employee of the agency to have a day off with pay on Cesar Chavez Day in lieu of any other state holiday that occurs on a weekday, other than a weekday on which an election is held throughout the state, on which the states agency is required to be open but on which the operations of the agency are required to be maintained at only a minimum level. Requires each state agency on to remain open on Cesar Chavez Day and conduct the operations of the agency at a minimum level. Provides that a holiday allowed under this section is in lieu of another holiday prescribed by law. Provides that the total number of holidays in a year to which an employee of a state agency is entitled is not changed by this section. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause. SUMMARY OF COMMITTEE CHANGES SECTION 1. Deletes amendments to Section 662.021, Government Code, regarding dates of holidays, and adds Section 662.031, regarding an optional holiday for Cesar Chavez Day. SECTION 2. Deletes amendments to Section 662.003(b), Government Code, regarding state holidays. Resdesignates SECTION 3 as SECTION 2. SECTION 3. Redesignates SECTION 4 as SECTION 3, and deletes SECTION 4.
