DIGEST 

Currently, Texas law specifies that the only individual who has any rights
of survivorship for a motor vehicle or a manufactured home is the surviving
spouse of the deceased.  This bill replaces text specifying "husband and
wife" with "person or persons" in rights of survivorship transfers of a
motor vehicle or manufactured home. 

PURPOSE

As proposed, S.B. 108 provides that the rights of survivorship transfer of
a motor vehicle or manufactured home be given to a person or persons rather
than a spouse or husband and wife. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 501.031, Transportation Code, to require a
rights of survivorship form to provide that if the agreement is signed by
two persons, rather than a husband and a wife, the motor vehicle is held
jointly by those persons.  Provides that rights of survivorship go to
either surviving person, rather than the surviving spouse.  Makes
conforming changes. 

SECTION 2.  Amends Section 19(a)(2), Article 5221f, V.T.C.S. (Texas
Manufactured Housing Standards Act), to redefine "document of title." 

SECTION 3.  Amends Section 19(h), Article 5221f, V.T.C.S. (Texas
Manufactured Housing Standards Act), to make conforming changes. 

SECTION 4.  Effective date:  September 1, 1999.

SECTION 5.  Emergency clause.
