DIGEST 

Currently, Texas law requires a person to report abuse or neglect
conditions in a nursing home or other related institution under Chapter
242, Health and Safety Code. S.B. 109 will repeal Section 242.1225, Health
and Safety Code, regarding an additional reporting requirement, and will
authorize a public member of the long-term care legislative oversight
committee (committee) to be reimbursed for committee expenses. 

PURPOSE

As enrolled, S.B. 109 repeals Section 242.1225,  and authorizes a public
member of the long-term care legislative oversight committee (committee) to
be reimbursed for travel expenses incurred while conducting committee
business.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer: Section 242.1225, Health and Safety Code (Additional
Reporting Requirement). 

SECTION 2. Amends Section 242.066(f), Health and Safety Code, to delete
text regarding a penalty for a violation of a rule adopted under Section
242.1225. 

SECTION 3. Amends Section 242.0655(b), Health and Safety Code, to make a
conforming change. 

SECTION 4. Amends Section 242.652, Health and Safety Code, by adding
Subsection (d), to authorize a public member of the long-term care
legislative oversight committee (committee) to be reimbursed for the travel
expenses incurred by the member while conducting the business of the
committee at the rate established in the General Appropriations Act. 

SECTION 4. Emergency clause.
                      Effective date: upon passage.
