SRC-AXB S.B. 123 76(R) BILL ANALYSIS Senate Research Center S.B. 123 76R2627 ESH-DBy: Bivins State Affairs 3/5/1999 As Filed DIGEST Currently, a member of the Texas Legislature is authorized to represent clients in contested cases before a state agency, perform administrative duties, and file documents on behalf of a client. This bill would prohibit representation for compensation by a member of the legislature, by removing an exception allowing a member to perform such duties. PURPOSE As proposed, S.B. 123 removes exceptions allowing a member of the legislature to receive compensation for representing another person before a state agency. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 572.052(a), Government Code, to delete text which provides exceptions allowing a member of the legislature to represent another person for compensation before a state agency. SECTION 2. Amends Section 572.021, Government Code, to require a state officer, candidate for office, and a party chairman to file with the Texas Ethics Commission a verified financial statement complying with Sections 572.022 through 572.024, rather than through Section 572.025. SECTION 3. Repealer: Section 572.025, Government Code (Information About Legislators' Representation Before Executive State Agencies). SECTION 4. Effective date: September 1, 1999. SECTION 5. Makes application of this Act prospective. SECTION 6. Emergency clause.
