HBA-EVB S.B. 132 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 132 By: Nixon Transportation 4/28/1999 Engrossed BACKGROUND AND PURPOSE Currently, Texas law allows disabled persons to register and acquire special license plates and vehicle parking placards. Such persons are required to procure a written statement from a physician licensed in Texas. However, some persons living in areas near the state line may have physicians in another state. S.B. 132 allows disabled persons to acquire a written statement from physicians licensed in a state adjacent to Texas, for the purposes of registering and acquiring special license plates and vehicle parking placards. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subsection (e), Section 502.253, Transportation Code, as follows: (e) Provides that the first application for registration must be accompanied by a written statement of a physician licensed to practice medicine in this state or a state adjacent to this state, or authorized by applicable law to practice medicine in a hospital or other health facility of the Veterans Administration. SECTION 2. Amends Subdivision (5), Section 681.001, Transportation Code, to make a conforming change. SECTION 3. Amends Subsection (c), Section 681.003, Transportation Code, to make a conforming change. SECTION 4. Emergency clause. Effective date: upon passage.
