DIGEST 

Currently, only counties meeting certain population definitions may charge
attorney's fees or collect civil penalties when adopting and enforcing
Flood Plan Management Regulations.  S.B. 142 expands enforcement of the
Flood Control Insurance Act to include counties having a minimum population
of 2.8 million or certain counties with a population of 270,000 or more. 

PURPOSE

As enrolled, S.B. 142 expands enforcement of the Flood Control and
Insurance Act to include certain counties. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 16.323(c), Water Code (Flood Control and
Insurance Act), to provide that this section applies only to a county that
contains two or more municipalities with a population of 250,000 or more;
the county has a population of 2.8 million or more; or the county has a
population of 270,000 or more and is adjacent to two or more counties each
of which has a population of one million or more.  Makes conforming
changes. 

SECTION 2.  Emergency clause.
  Effective date:  upon passage.
