SRC-PNG S.B. 143 76(R) BILL ANALYSIS Senate Research Center S.B. 143 76R3702 SMJ-DBy: Brown Natural Resources 2/22/1999 As Filed DIGEST Currently, Texas law mandates that all waters subject to interbasin transfers would be junior in priority to all other waters within that originating basin. PURPOSE As proposed, S.B. 143 repeals a section of the Water Code relating to the priority of a water right authorizing a transfer of water from a river basin in this state to another river basin. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 11.085(s), Water Code (regarding the priority of a water right authorizing an interbasin water transfer). SECTION 2. Makes application of this Act prospective. SECTION 3.
