DIGEST 

Currently, Texas law mandates that all waters subject to interbasin
transfers would be junior in priority to all other waters within that
originating basin.  Thus during times of water shortage, all obligations
within the basin would be fulfilled before any waters could be transferred
as provided for in an interbasin transfer permit.  This bill repeals those
sections of the Water Code. 

PURPOSE

As proposed, C.S.S.B. 143 repeals sections of the Water Code relating to
the priority of a water right authorizing a transfer of water from a river
basin in this state to another river basin.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer:  Sections 11.085(s) and (t), Water Code (regarding the
priority of a water right authorizing an interbasin water transfer). 

SECTION 2. Makes application of this Act prospective.  

SECTION 3. Emergency clause.
  Effective date: upon passage.
