HBA-PDH S.B. 163 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 163 By: Carona Criminal Jurisprudence 4-9-1999 Engrossed BACKGROUND AND PURPOSE Currently, the fee for executing or processing an issued warrant is $35. This fee has not been increased in ten years. S.B. 163 raises the fee for executing or processing an issued warrant or capias from $35 to $50, in order to allow counties to recoup more of the costs for the service. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 102.011(a), Code of Criminal Procedure, to increase the fee from $35 to $50 for executing or processing an issued arrest warrant or capias, which a defendant convicted of a felony or misdemeanor is required to pay. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
