SRC-JJJ S.B. 163 76(R)BILL ANALYSIS Senate Research CenterS.B. 163 By: Carona Criminal Justice 6/23/1999 Enrolled DIGEST Currently, Texas law requires a defendant convicted of a felony to pay a $35 fee to a peace officer for the executing or processing of an issued arrest warrant or capias. This bill will increase the fee to $50. PURPOSE As enrolled, S.B. 163 increases the fee paid by a defendant for the execution or processing of an arrest warrant or capias. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 102.011(a), Code of Criminal Procedure, to increase the fee from $35 to $50 paid by a defendant convicted of a felony or a misdemeanor for executing or processing an issued arrest warrant or capias by a peace officer. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
