HBA-KMH PDH-S.B. 179 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 179 By: Shapiro Judicial Affairs 3/25/1999 Engrossed BACKGROUND AND PURPOSE Due to the growing population of Collin County, the need for a statutory probate court specializing in mental health and probate matters has increased. S.B. 179 redesignates County Court at Law No. 1 of Collin County as the Probate Court of Collin County. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 25.0451, Government Code, as follows: Sec. 25.0451. COLLIN COUNTY. (a) Removes the County Court at Law No. 1 of Collin County from the existing statutory county courts. Redesignates existing Subdivisions (2)-(4) to Subdivisions (1)-(3). (b) Provides that Collin County has one statutory probate court: the Probate Court of Collin County. SECTION 2. Redesignates the County Court at Law No. 1 of Collin County as the Probate Court of Collin County. Provides that the judge of the existing County Court at Law No. 1 will preside as the judge of the Probate Court of Collin County. SECTION 3.Effective date: September 1, 1999. SECTION 4.Emergency clause.
