MPA S.B. 189 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 189 By: Ogden County Affairs 3/15/1999 Engrossed BACKGROUND AND PURPOSE Currently, Texas law requires the election of the Burleson County Hospital District board of directors to be held on the first Saturday in April. H.B. 950 requires the Burleson County Hospital District board of directors election to be held in accordance with Chapter 41 (Election Dates and Hours for Voting), Election Code, and requires a candidate to file an application to have the candidate's name printed on the ballot 45 days prior to election. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 8, Chapter 726, Acts of the 65th Legislature, Regular Session, 1977, as follows: Sec. 8. Deletes the requirement that an election for the board of directors of the Burleson County Hospital District be held in the district on the first Saturday of each April after approval by the qualified voters of the district. Requires that subsequent elections be held each following year in continuing sequence in accordance with Chapter 41, Election Code (Election Dates and Hours for Voting), rather than the first Saturday in April. Provides that an application for any candidate for the office of director be filed with the secretary of the board no later than 5 p.m. of the 45th day before the election, rather than requiring the application to be filed at least 15 days before the election. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
