SRC-AXB S.B. 243 76(R) BILL ANALYSIS Senate Research Center S.B. 243 76R4591 DB-DBy: Ellis Jurisprudence 2/18/1999 As Filed DIGEST Currently, the Department of Public Safety is required to provide the secretary of state with a list of citizens' names used to reconstitute the jury wheel, including the citizenship status of those names. Because driver's license lists and voter registration lists have been combined, people with numerous licenses can receive duplicate or unnecessary summonses. This bill would remove the names of nonUnited States citizens and duplicate names from the jury wheel, thereby increasing its efficiency. PURPOSE As proposed, S.B. 243 requires the Department of Public Safety to inform the secretary of state of the citizenship status of certain people by simply excluding their names from a list used to reconstitute a jury wheel, rather than indicating their citizenship status on that list. S.B. 243 also requires duplicate names of registrants to be excluded. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 62.001(f), Government Code, to require the list furnished by the Department of Public Safety (DPS) to exclude the names of non-United States citizens, and duplicate names of registrants. Deletes the requirement that DPS inform the secretary of state of the citizenship status of names required under Subsection (a)(2). SECTION 2.Emergency clause. Effective date: upon passage.
