SRC-JJJ S.B. 260 76(R)BILL ANALYSIS Senate Research CenterS.B. 260 By: Bivins Education 7/13/1999 Enrolled DIGEST Currently, Texas law mandates students who assault another person on school grounds or at a schoolrelated event to be placed in an alternative education program. Intentionally, knowingly, or recklessly causing bodily injury to another does not currently warrant expulsion. S.B. 260 will include assault, by a student against school employees or volunteers, as an offense punishable by expulsion. PURPOSE As enrolled, S.B. 260 establishes conditions regarding expulsion of a public school student who assaults a school employee. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subsections (b) and (d), Section 37.007, Education Code, to authorize a student to be expelled if, while on school property or attending a school-sponsored or school-related activity on or off school property, the student engages in conduct that contains elements of an offense under Section 22.01(a)(1), Penal Code, against a district employee or a volunteer as defined by Section 22.053. Provides that a student may be expelled if the student engages in conduct that contains the elements of any offense listed in Subsection (b)(3) against certain individuals without regard to the place and time the offense occurs. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3.Emergency clause. Effective date: upon passage.
