HBA-NMO S.B. 284 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 284 By: Brown Criminal Jurisprudence 4/5/1999 Engrossed BACKGROUND AND PURPOSE Current law authorizes a prosecutor to collect a fee of $10 for collecting and processing a dishonored or forged check or similar sight order of which the face value does not exceed $100. S.B. 284 changes the fee to $10 if the face amount of the check or sight order does not exceed $10, and $15 if the face amount of the check or sight order is greater than $10, but does not exceed $100. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 102.007(c), Code of Criminal Procedure, to prohibit the amount of the fee collected by a prosecutor for collecting and processing a dishonored or forged check or similar sight order from exceeding $10, if the face amount of the check or sight order does not exceed $10, rather than $100. Prohibits the amount of the fee from exceeding $15 if the face amount of the check or sight order is greater than $10, but does not exceed $100. Makes conforming changes. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
