DIGEST 

Currently, there is no limitation on buildings used as a polling place for
certain elections regarding their connection to the issues to be voted on.
Sometimes, election locations are "strategically placed" - for example, an
election to approve bonds for a new school gymnasium can be held in the old
gymnasium, so while people are voting, they can observe the current
condition of the facility. This bill will prohibit certain kinds of
elections from being held in a building that is affected by the result of
the election. 

PURPOSE

As proposed, S.B. 309 prohibits certain kinds of elections from being held
in a building that is affected by the result of the election. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 43B, Election Code, by adding Section 43.035, as
follows: 

Sec. 43.035.  LIMITATION ON USE OF BUILDINGS AFFECTED BY CERTAIN ELECTIONS.
Prohibits an election for approval of the issuance or assumption of bonds
from being held in a building directly related to the purpose for which
expenditures may be made as a result of the election. 

SECTION 2.  Effective date:  September 1, 1999.

SECTION 3.  Emergency clause.
