SRC-ARR S.B. 314 76(R) BILL ANALYSIS Senate Research Center S.B. 314 76R3415 GJH-DBy: Ellis Health Services 2/28/1999 As Filed DIGEST Currently, Texas law requires applicants for cosmetology licenses to obtain or renew health certificates. While licensed physicians or licensed physician assistants may currently sign health certificates, advanced practice nurses may not. S.B. 314 would expand signature authority to include advanced practice nurses and would strike the requirement for hepatitis testing from health certificates requirements. PURPOSE As proposed, S.B. 314 includes advanced practice nurses among those health professionals qualified to sign health certificates required for certain licenses and certificates issued by the Texas Cosmetology Commission. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 31, Article 8451a, V.T.C.S. to require every applicant for an original or renewal operator license, and certain other licenses or specialty certificate to submit a certificates of health signed by a licensed physician, advanced practice nurse, or licensed physician assistant, showing that the applicant is free from tuberculosis or any other contagious disease. Makes conforming changes. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
