DIGEST 

Currently, under Texas law, unemployment benefit claims are determined
based on wages earned during a week.  This bill disqualifies an applicant
for unemployment benefits for a benefit period in which the applicant works
at least 40 hours, without regard to the rate of pay, in conformity with
federal law. 

PURPOSE

As proposed, S.B. 335 disqualifies an applicant for unemployment benefits
for a benefit period in which the applicant works at least 40 hours. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 201.091, Labor Code, by adding Subsection (e), to
provide that an individual is not considered unemployed and is not eligible
to receive unemployment compensation benefits for any benefit period in
which the individual works at least 40 hours. 

SECTION 2. Effective date: September 1, 1999.
  Makes application of this Act prospective.

SECTION 3. Emergency clause.
