DIGEST 

Currently, a county commissioners court (court) must hold a public hearing
on a proposed budget within 7 days after the day the budget is filed with
the county clerk.  However, the court is required to publish notice of the
hearing no later than the 10th day before the date of the hearing.
Therefore, the public is unable to view the proposed budget for 3 days
after notice of the hearing is posted.  This bill changed the period of
time that the court must hold a public hearing after a proposed budget is
filed with the county clerk from 7 days to 10 days, to allow the public the
full 10 days to review the proposed budget before the hearing. 

PURPOSE

As enrolled, S.B. 338 requires a county commissioners court to hold a
hearing on a proposed budget within a certain time period. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 111.038(b), Local Government Code, to require a
county commissioners court to hold a hearing on a proposed budget within 10
calendar days, rather than 7 days, after the  proposed budget is filed but
before a certain date. 

SECTION 2. Amends Section 111.067(b), Local Government Code, to make a
conforming change. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
