BACKGROUND AND PURPOSE 

Currently, an individual who receives or has received wages in lieu of
notice or certain public compensation for qualified disabilities is
disqualified from unemployment compensation benefits. This bill expands
current law by disqualifying individuals from unemployment compensation
benefits if the individual is receiving or has received severance pay,
except severance pay that is explicitly outlined in a group employment
contract. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 207.049, Labor Code, as follows:

(a) Provides that an individual is disqualified for unemployment
compensation benefits for a benefit period for which the individual is
receiving or has received remuneration in the form of severance pay, except
severance pay that is explicitly outlined in a group employment contract.   

(b) Provides that the individual is entitled to receive benefits for the
benefit period that are reduced by the amount of the adjusted remuneration
as provided by Section 207.006 (Adjustment of Benefits), notwithstanding
Subsection (a), if the remuneration received by the individual is less than
the benefits that the individual would otherwise be eligible to receive. 

SECTION 2.  Effective date: September 1, 1999.
                       Makes application of this Act prospective.

SECTION 3.  Emergency clause.
