SRC-JJJ S.B. 395 76(R) BILL ANALYSIS Senate Research Center S.B. 395 76R2740 SMJ-DBy: Carona Intergovernmental Relations 2/19/1999 As Filed DIGEST In 1935, the 44th Legislature adopted a bracket bill for Harris County that required all county employees to be employed by a written contract. This Act was recodified as Section 151.902, Local Government Code. Since the adoption of this legislation, several counties have grown into the population bracket once meant specifically for Harris County-"with a population of 500,000 or more." Dallas County is one of those counties, and because Dallas County employees are covered by a civil service system, the protections of this section of the Local Government Code are unnecessary. This bill would exclude Dallas County from the provisions of Section 151.902, Local Government Code. PURPOSE As proposed, S.B. 395 establishes conditions concerning the employment of a person by counties with a civil service system. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 151.902, Local Government Code, by adding Subsection (d), to provide that this section does not apply to the employment of a person under a county civil service system created under Chapter 158. SECTION 2. Emergency clause. Effective date: upon passage.
