DIGEST 

Currently, Walker County is in need of office space for certain
governmental departments and judicial services.  The Texas Department of
Criminal Justice (TDCJ) has offered to donate a building across from the
Walker County Courthouse in order to alleviate Walker County's office space
problems.  This bill transfers certain state property from TDCJ to Walker
County. 

PURPOSE

As proposed, S.B. 463 transfers certain state property from the Texas
Department of Criminal Justice to Walker County. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.     Requires the Texas Department of Criminal Justice (TDCJ) to
transfer the real property described by Subsection (e) to Walker County by
January 31, 2000.  Authorizes Walker County to use the transferred property
only for a purpose that benefits the public interest of the state. Requires
Walker County to sell the property for fair market value under the
procedures provided by Section 272.001, Local Government Code, and forward
the proceeds to TDCJ if Walker County no longer uses the property for the
required purpose.  Requires TDCJ to deposit the proceeds received from the
sale in the Texas capital trust fund.  Requires TDCJ to transfer the
property by an appropriate instrument of transfer.  Requires certain
provisions to be included in the instrument of transfer.  Requires TDCJ to
retain custody of the instrument of transfer after the instrument is filed
in the Walker County real property records.  Sets forth the legal
description of the property to be transferred. 

SECTION 2.Emergency clause.
Effective date: upon passage.
