Currently, Texas law provides funding to a juvenile justice alternative
education program for the portion of the school year for which the program
provides educational services. However, no funds are provided for
transporting students to and from the program. This bill would authorize
an allotment for transportation comparable to the allotment available to a
school district that provides special transportation services to eligible
special education students.
PURPOSE
As proposed, S.B. 470 establishes state financial assistance for juvenile
justice alternative education programs that provide student transportation.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 42.155, Education Code, by adding Subsection
(k), to entitle the juvenile board of a county that operates a juvenile
justice alternative education program to an allotment for each student who
receives transportation to the program from the juvenile board. Requires
the commissioner of education to determine the appropriate allotment.
Requires the allotment to be comparable to the allotment available to a
school district that provides special transportation services to eligible
special education students.
SECTION 2. Provides that this Act applies beginning with the 1999-2000
school year.
SECTION 3. Emergency clause.
Effective date: upon passage.
