Currently, Texas law requires the Firefighters' and Police Officers' Civil
Service Commission to provide the classification of fire fighters and
police officers. S.B. 554 would reclassify the position of fire marshal in
certain municipal fire departments.
PURPOSE
As proposed, S.B. 554 reclassifies the position of fire marshal in certain
municipal fire departments.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 143G, Local Government Code, by adding Section
143.1025, as follows:
Sec. 143.1025. CLASSIFICATION OF FIRE MARSHAL. (a) Requires the
municipality's governing body to establish the classification of fire
marshal by ordinance, in addition to other firefighter classifications
created in accordance with Section 143.021.
(b) Authorizes the classified position of fire marshal to only be filled
from an eligibility list that results from an examination held in
accordance with this chapter.
(c) Provides that the failure of the governing body to establish the fire
marshal position by ordinance does not result in the loss of civil service
benefits by a person entitled to civil service protection or appointed to
the position in substantial compliance with this chapter.
SECTION 2. Emergency clause.
Effective date: upon passage.
