DIGEST 

Currently, single-family dwellings subsidized with state or federal money
are not required to meet certain basic accessibility construction
requirements.  This bill establishes certain accessibility requirements for
the construction of certain state or federal subsidized single family
dwellings. 

PURPOSE

As enrolled, S.B. 623 establishes certain accessibility requirements
applicable to the construction of speculative homes. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 2306X, Government Code, by adding Section
2306.514, as follows: 

Sec.  2306.514.  CONSTRUCTION REQUIREMENTS FOR AFFORDABLE HOUSING. Sets
forth certain construction requirements on single family affordable homes
subsidized with state or federal money administered by the Texas Department
of Housing and Community Affairs  (TDHCA). Authorizes a person who builds
single family affordable housing to which this section applies to obtain a
waiver from TDHCA of the grading requirement described in Subsection
(a)(1)(A) if the cost of grading the terrain to meet the requirement is
prohibitively expensive.  
 
SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1999.

SECTION 4. Emergency clause.
