DIGEST 

Currently, single-family dwellings subsidized with state or federal money
are not required to meet certain basic accessibility construction
requirements.  This bill establishes certain accessibility requirements for
the construction of certain state or federal subsidized single family
dwellings. 

PURPOSE

As proposed, S.B. 623 establishes certain accessibility requirements
applicable to the construction of speculative homes. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 2306X, Government Code, by adding Section
2306.514, as follows: 

Sec.  2306.514.  SPECULATIVE HOMES.  Defines "speculative home."  Provides
certain construction requirements on homes subsidized with state or federal
money administered by the Texas Department of Housing and Community
Affairs.  Authorizes a person who builds a home to which this section
applies to obtain a waiver of the grading requirement described in
Subsection (b)(1)(A) if the cost of grading the terrain to meet the
requirement is prohibitively expensive.  Requires a person to request the
waiver from the appropriate governmental authority authorized to issue
building permits or otherwise regulate the construction of homes in the
area in which the speculative home is located.  

SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1999.

SECTION 4. Emergency clause.
