This bill establishes certain accessibility requirements for the construction of certain state or federal subsidized single family dwellings. PURPOSE As proposed, C.S.S.B. 623 establishes certain accessibility requirements applicable to the construction of speculative homes. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 2306X, Government Code, by adding Section 2306.514, as follows: Sec. 2306.514. CONSTRUCTION REQUIREMENTS FOR AFFORDABLE HOUSING. Sets forth certain construction requirements on affordable homes subsidized with state or federal money administered by the Texas Department of Housing and Community Affairs (TDHCA). Authorizes a person who builds affordable housing to which this section applies to obtain a waiver from TDHCA of the grading requirement described in Subsection (a)(1)(A) if the cost of grading the terrain to meet the requirement is prohibitively expensive. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause. SUMMARY OF COMMITTEE CHANGES SECTION 1. Amends Section 2306.514, Chapter 2306X, Government Code, to provide a new heading, and set forth certain construction requirements on affordable homes subsidized with state or federal money administered by TDHCA. Authorizes a person who builds affordable housing to which this section applies to obtain a waiver from TDHCA of the grading requirement described in Subsection (a)(1)(A) if the cost of grading the terrain to meet the requirement is prohibitively expensive. Deletes the definition of "speculative home." Deletes proposed text requiring a person to request the waiver from the appropriate governmental authority authorized to issue building permits or otherwise regulate the construction of homes in the area in which the speculative home is located. Makes conforming changes.
