DIGEST 

Currently, Texas law requires court clerks to send protective orders to law
enforcement, child care facilities and schools through certified mail.  The
results of this process is that it may take several days after the
protective order is issued for it to reach the proper authorities.
C.S.S.B. 685 would establish the delivery via the regular mail, facsimile
transmission, or electronic mail of protective orders to certain affected
persons. 

PURPOSE

As proposed, C.S.S.B. 685 establishes the delivery via the regular mail,
facsimile transmission, or electronic mail of protective orders to certain
affected persons. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 85.042, Family Code, by amending Subsection (d)
and adding Subsection (e), to require an applicant or an applicant's
attorney to provide to the clerk of the courts certain information,
including a facsimile number, electronic mail address, if any, or mailing
address of certain locations.  Authorizes a copy of an order to be sent by
facsimile transmission, or electronic mail.  Requires a written
verification of the receipt f the facsimile or electronic mail by the clerk
to be placed with the court papers.   

SECTION 2.  Emergency clause.
            Effective date: upon passage.

SUMMARY OF COMMITTEE CHANGES

Amends Section 85.042(e), Family Code, to require a written verification of
the receipt of the facsimile transmission or electronic mail by the clerk
to be placed with papers of the court.
