DIGEST 

Currently, Texas law provides minimal regulation for property owners'
association elections.  As property owners' associations have grown at a
rapid pace in recent years, problems have arisen in how these elections are
conducted.  This bill would require ballot position in a property owners'
association election to be determined by random drawing. 

PURPOSE

As proposed, S.B. 726 provides guidelines for property owners' association
elections. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 202, Property Code, by adding Section 202.006, as
follows: 

Sec. 202.006. PROPERTY OWNERS' ASSOCIATION ELECTION. Requires the governing
body of a property owners' association to be selected in accordance with
provisions of the dedicatory instrument and the association's articles of
incorporation.  Requires the order of the names of the candidates on a
ballot for the election of members to the association's governing body to
be determined by a drawing. 

SECTION 2.Emergency clause.
  Effective date: upon passage.
