DIGEST 

Currently, certain political subdivisions are subject to liability issues
regarding power lines located on public property.  S.B. 740 would regulate
damages resulting from persons who inadvertently come into contact with a
high voltage line. 

PURPOSE

As proposed, S.B. 740 regulates damages resulting from contact with a high
voltage line. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 752.008, Health and Safety Code, to provide that
this section does not affect the immunity of the state or a political
subdivision of the state.  Prohibits an owner or operator of a high voltage
overhead line from recovering damages under this section from the state or
any political subdivision of the state. 

SECTION 2.Emergency clause.
  Effective date: upon passage.
