DIGEST 

Currently, under Texas law, Texas Department of Public Safety officers may
only enforce weight restrictions on public highways, and they are unable to
cite overweight vehicles in ports-of-entry. This bill would provide for the
enforcement of weight limits for certain vehicles at a port-of-entry
between Texas and Mexico. 

PURPOSE

As proposed, S.B. 749 provides for the enforcement of weight limits for
certain vehicles at a port-ofentry between Texas and Mexico. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 621.101(a), Transportation Code, to enforce
weight limits for certain vehicles at any port-of-entry between Texas and
Mexico. 

SECTION 2. Amends Section 621.408, Transportation Code, to grant authority
to weight enforcement officers to enforce weight limits for certain
vehicles at a port-of-entry between Texas and Mexico. 

SECTION 3. Effective date: September 1, 1999.

SECTION 4. Emergency clause.
