A research study conducted by Nustats International conducted for the Texas
Department of Transportation on the topic of littering has shown what types
of people tend to litter, the effectiveness of the current anti-litter
campaigns, and current trends on the type of litter being discarded along
Texas roads.  S.B. 777 will require litter prevention information to be
included in the curriculum of certain driver education and driving safety
courses. 

PURPOSE

As enrolled, S.B. 777 requires litter prevention information to be included
in the curriculum of certain driver education and driving safety courses. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the commissioner of education or a
person knowledgeable in the administration of regulating driver training
schools and designated by the commissioner of education to administer the
Texas Driver and Traffic Safety Education Act in SECTION 1 (Section 6(a)
and (c), Article 4413(29c), V.T.C.S.) of this bill.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 6, Article 4413(29c), V.T.C.S. (Texas Driver and
Traffic Safety Education Act), to require the commissioner of education or
a person knowledgeable in the administration of regulating driver training
schools and designated by the commissioner to administer the Texas Driver
and Traffic Safety Education Act (commissioner) to adopt rules necessary to
implement this Act and enforce rules adopted by the commissioner, rather
than the board.  Provides that a reference in another provision of this Act
to a rule adopted by the board means a rule adopted by the commissioner.
Requires the commissioner, by rule, to require information relating to
litter prevention be included in the curriculum of each driver education
and driver safety course.  Requires the commissioner to consult with the
Department of Public Safety in developing the rules.  Deletes text
authorizing the commissioner to adopt and enforce temporary rules. 

SECTION 2.  Requires the commissioner of education to adopt rules, except
as provided by Subsection (b), not later than January 1, 2001.  Provides
that a rule adopted before the effective date of this Act remains in effect
until superseded by a rule adopted by the commissioner of education.
Requires the commissioner to adopt the rules under Subsection 6(c), Article
4413(29c), V.T.C.S., not later than January 1, 2000. 

SECTION 3.  Emergency clause.
            Effective date: upon passage.
