SRC-JXG S.B. 822 76(R) BILL ANALYSIS Senate Research Center S.B. 822 By: Gallegos Intergovernmental Relations 4/6/1999 As Filed DIGEST Currently, Chapter 396, Transportation Code, establishes fencing requirements, location requirements, and licensing requirements for certain salvage yards, and entitles a person to an injunction prohibiting a violation or threatening a violation. Chapter 397, Transportation Code, applies to automotive wrecking and salvage yards that were established after September 1, 1983, in unincorporated areas of Harris County. S.B. 822 would provide the injunction remedy under Chapter 396 to Chapter 397 for a violation at wrecking and salvage yards in unincorporated areas of Harris County. PURPOSE As proposed, S.B. 822 authorizes a county to bring an injunction to prohibit a violation or threatened violation relating to automobile wrecking and salvage yards. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 397, Transportation Code, by adding Section 397.014, as follows: Sec. 397.014. INJUNCTION. Authorizes a county to bring an action for an injunction to prohibit a violation or threatened violation of this chapter. Provides that the venue for the injunction proceeding is in the county in which any part of the automobile wrecking or salvage yard is located. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
