HBA-JRA S.B. 876 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 876 By: Shapiro Public Education 5/18/1999 Engrossed BACKGROUND AND PURPOSE Currently, Texas law grants the commissioner of education the authority to order closure of the school program on a campus that is rated as "low performing." In Texas, this process is only used in extreme cases. S.B. 876 authorizes the commissioner of education to order that some or all of the educators employed on a low-performing campus for at least the two preceding years be reassigned to other campuses or other appropriate positions in the school district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.131(b), Education Code, to authorize the commissioner of education, if a campus performance is below any standard under Section 39.073(b) or a campus is considered a low-performing campus for a period of two years or more, to order that some or all of the educators employed on the campus for at least the two preceding years be reassigned to other campuses or other appropriate positions in the school district. SECTION 2. Makes application of this Act prospective to the 1999 - 2000 school year. SECTION 3.Emergency clause. Effective date: upon passage.
