BACKGROUND AND PURPOSE

Currently, Texas law grants the commissioner of education the authority to
order closure of the school program on a campus that is rated as "low
performing." In Texas, this process is only used in extreme cases. S.B.
876 authorizes the commissioner of education to order that some or all of
the educators employed on a low-performing campus for at least the two
preceding years be reassigned to other campuses or other appropriate
positions in the school district.

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
