DIGEST 

Currently, the state provides five days per year of state sick/personal
leave.  In 1991, the legislature authorized a school retiree who had 50
days of unused sick leave to purchase an additional year of credit for
retirement purposes.  S.B. 902 would delete certain requirements that the
retiree pay for the additional year of credit if he or she retires with 50
or more days of unused sick leave. 

PURPOSE

As proposed, S.B. 902 deletes certain requirements regarding the service
credit in the Teacher Retirement System of Texas for accumulated personal
or sick leave. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 823.403, Government Code, to delete the
requirement that a payment must be received according to Subsection (d) in
order to receive credit from the Teacher Retirement System.  Deletes the
requirement that a member must make certain payment in order to receive
credit.  Deletes a provision that an employer may reimburse an employee for
the cost of purchasing credit under this section. 

SECTION 2.Effective date:  September 1, 1999.
  Makes application of this Act prospective.

SECTION 3.  Emergency clause.
