SRC-ARR S.B. 911 76(R) BILL ANALYSIS Senate Research Center S.B. 911 76R7464 CAS-DBy: Shapleigh Education 4/19/1999 As Filed DIGEST Currently, Texas law leaves discretion with the commissioner of education (commissioner) to take certain actions with regard to a public school campus which is determined to be low-performing. S.B. 911 would require the commissioner to take one or more actions in regard to a campus which is determined to be low-performing and would continue to allow the commissioner discretion in choosing to appoint a board of managers or to order closure of the school program on that campus. PURPOSE As proposed, S.B. 911 requires certain sanctions to be imposed on low-performing public school campuses. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.131, Education Code, by amending Subsection (b) and adding Subsections (b-1) and (b-2), to require, rather than authorize, the commissioner of education (commissioner) to take one or more of certain actions, if a public school campus performance is below any standard under Section 39.073(b). Authorizes the commissioner to appoint a board of managers composed of residents of the school district to exercise the powers and duties of the board of trustees of the district in relation to the campus, if a campus has been a low-performing campus for period of one year or more. Makes a conforming change. SECTION 2. Emergency clause. Effective date: upon passage.
