DIGEST 

Currently, a licensed driver age 18 or older who accompanies a student
driver can be asleep without violating the statute.  Current law requires
accompaniment, rather than supervision from the accompanying driver.
C.S.S.B. 923 increases the level of required responsibility from the
accompanying driver by creating an offense for certain behavior.  

PURPOSE

As proposed, C.S.S.B. 923 creates an offense for certain behavior by a
person in a vehicle operated by an instruction permit holder. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 521.222, Transportation Code, by adding
Subsection (f), to create an offense for a person who sleeps, is
intoxicated, or is engaged in distracting behavior while occupying a seat
in a vehicle operated by an instruction permit holder. 

SECTION 2.  Effective date:  September 1, 1999.

SUMMARY OF COMMITTEE CHANGES

Deletes proposed SECTION 1, and amends Section 521.222, Transportation
Code, by adding text regarding an offense.
