HBA-MPM S.B. 993 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 993 By: Lindsay Higher Education 5/2/1999 Engrossed BACKGROUND AND PURPOSE Current law exempts children of certain disabled peace officers and firemen from tuition payments at state junior colleges, universities, and colleges. Under Section 54.204(e)(1), Education Code, a person forfeits the tuition exemption when he or she transfers from the four-year college or university he or she first attended to another. S.B. 993 eliminates the provision limiting children of disabled peace officers and firemen by forfeiting their tuition exemption if they transfer from certain colleges or universities. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 54.204(e) (Children of Disabled Firemen and Peace Officers), Education Code. This subsection entitles a person to an exemption under the provisions of this section to use the exemption only at the public senior college or university which the person first attends under the provisions of this section; or only at the public junior college which the person first attends, and upon successful completion of four consecutive semesters at the public junior college the person may continue to use the exemption for four consecutive semesters only at the public senior college or university subsequently attended. SECTION 2. Makes this Act applicable beginning with the 1999 fall semester. SECTION 3.Emergency clause. Effective date: upon passage.
