SRC-AXB S.B. 1009 76(R) BILL ANALYSIS Senate Research Center S.B. 1009 By: Brown Infrastructure 3/22/1999 As Filed DIGEST Although the Texas Turnpike Authority Division of the Texas Department of Transportation (TTA) is currently exempted from the requirement of attorney general approval for outside contracts, confusion remains concerning TTA's authority to procure contractual services. This bill clarifies TTA's authority concerning turnpike projects. PURPOSE As proposed, S.B. 1009 limits the application of existing laws regarding the procurement of legal services by the Texas Turnpike Authority Division of the Texas Department of Transportation. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 402.0212(c), Government Code, to specify that this section does not apply to the Texas Turnpike Authority division of the Texas Department of Transportation. SECTION 2. Amends Section 361.031, Transportation Code, by adding Subsection (h), to provide that this section does not apply to the procurement of legal services. SECTION 3.Emergency clause. Effective date: upon passage.
