SRC-ARR S.B. 1046 76(R) BILL ANALYSIS Senate Research Center S.B. 1046 By: Wentworth State Affairs 3/23/1999 As Filed DIGEST The Senate Interim Committee on Public Information recommended that the Sunset process be used to assist state agencies in making the connection between records management and accessibility for public information. S.B. 1046 would require the Sunset Advisory Commission to consider the extent to which an agency complies with the public information law and record management practices in determining whether an agency should continue in existence. PURPOSE As proposed, S.B. 1046 adds criteria for the Sunset Advisory Commission to use in its review of state agencies. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 325.011, Government Code, to require the Sunset Advisory Commission and its staff to consider the extent to which the agency complies with Chapters 551 and 552 and follows records management practices that enable the agency to respond efficiently to requests for public information. Effective date: 90 days after adjournment.
