SRC-JJJ S.B. 1059 76(R) BILL ANALYSIS Senate Research Center S.B. 1059 By: Bivins Higher Education 4/6/1999 As Filed DIGEST Currently, Texas law delegates to governing boards of general academic institutions, health-related institutions, and technical colleges the authority to construct, with oversight from the Texas Higher Education Coordinating Board (THECB), new educational and general space costing less than $300,000 and to undertake repair and renovation of educational and general space when the cost is less than $600,000. Due to inflation, and many projects that would not have previously come before THECB are now required to come before THECB. S.B. 1059 would establish provisions regarding certain construction projects by THECB. PURPOSE As proposed, S.B. 1059 establishes provisions regarding certain construction projects by the Texas Higher Education Coordinating Board. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.058(a), Education Code, to require the Texas Education Coordinating Board's (THECB) consideration and determination with regard to certain new or remodeling building projects if the cost is not more than $2,000,000, rather than $600,000. Provides that the requirement of approval for new construction applies only to projects the total cost of which is in excess of $1,000,000 rather than, $300,000. Makes conforming changes. SECTION 2. Emergency clause. Effective date: upon passage.
