DIGEST 

Currently, the Texas Board of Pharmacy (board) is authorized to license
community pharmacies, nuclear pharmacies, hospital pharmacies, or other
licensed inpatient facilities and clinics.  The board needs authority to
establish other classes of pharmacies when needed to protect the health,
safety, and welfare of Texan citizens, given the rapid changes in
technology and continual changes in the healthcare service delivery system.
C.S.S.B. 1086 would set forth provisions authorizing the creation of a new
class of pharmacy. 

PURPOSE

As proposed, C.S.S.B. 1086 sets forth provisions authorizing the creation
of a new class of pharmacy. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the Texas State Board of Pharmacy in
SECTION 1 (Subsections (c) (6) and (h), Article 4542a-1, V.T.C.S. (Texas
Pharmacy Act)) of this bill.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 4542a-1, V.T.C.S. (Texas Pharmacy Act), by
amending Subsections (b) and (c), and adding Subsection (h), to require
each pharmacy to apply for a license in or more classifications, including
another class of pharmacy established by the Texas State Board of Pharmacy
(board) under this section.  Requires certain pharmacies to be under the
supervision of certain pharmacists, including for any class of pharmacy
established by the board under this section, and requires the board, by
rule, for any class of pharmacy established by the board under this
section, to require the continuous on-site supervision of a pharmacist
during the time it is open for pharmacy services.  Authorizes the board, by
rule, to establish an additional class of pharmacy license under certain
board determinations.  Provides that anything in this Act shall require any
pharmacy to obtain an additional class of license for services the pharmacy
is currently providing. 

SECTION 2.Effective date: September 1, 1999.

SUMMARY OF COMMITTEE CHANGES

SECTION 1.  

Amends Article 4542a-1, V.T.C.S., to require certain pharmacies to be under
the supervision of certain pharmacists, including for any class of pharmacy
established by the board under this section, and requires the board, by
rule, for any class of pharmacy established by the board under this
section, to require the continuous on-site supervision of a pharmacist
during the time it is open for pharmacy services, rather than to determine
the amount of pharmacist supervision necessary for that class, which may
not be less than continuous supervision by a pharmacist. Provides that
nothing in this act shall require any pharmacy to obtain an additional
class of license for services the pharmacy is currently providing.
